Este trabajo tiene por fin indagar sobre el marco legal minero argentino y analizar si las tierras raras tienen algún régimen especial. También, examinar si existen normas ambientales que regulen su extracción y garanticen una actividad sustentable. Como objeto principal, este documento intenta esclarecer ciertos desafíos y vacíos regulatorios que existen con respecto a las tierras raras, con el fin de aportar ideas que permitan superarlos y agreguen valor al sector minero argentino.

This paper aims to explore the Argentine mining regulatory framework and assess whether rare earths are regulated under a special regime. Moreover, it reviews environmental legislation and examines whether the extraction of rare earths is duly regulated and environmentally sustainable. The main focus is to enlighten regulatory challenges and legal gaps regarding rare earths with the ultimate goal of solving them and adding value in the Argentine mining sector.
