El presente trabajo estudia el tránsito del régimen jurídico tradicional del mineral del carbón hacía una reforma derivada de los recientes decretos del Ejecutivo Nacional que declararon al carbón como mineral estratégico y de las posibles consecuencias, tanto para el Estado como para los operadores mineros, si se resuelve aplicar este nuevo régimen jurídico sobre los derechos mineros adquiridos con anterioridad a su entrada en vigor.

This paper studies the change from the traditional legal regulations of the coal mineral to a reform derived from the recent decrees from the National Executive that declared the coal a strategic mineral and the possible consequences, as much for the State as for the mining operators, if it is decided to apply this new legal regime over the already acquired mining rights, prior to its entry into force.
