Según la Constitución nacional, corresponde a las provincias el dominio originario de los recursos naturales en su territorio, siendo atribución del Congreso dictar el Código de Minería y los presupuestos mínimos de protección ambiental, sin alterar las jurisdicciones locales. Las provincias conservan todo el poder no delegado al Gobierno federal.

Under the National Constitution, the Provinces hold the original domain over the natural resources within their territory, while the Congress has the power to pass the Mining Code and the minimum standards of environmental protection provided that they do no interfere with the local jurisdictions. The Provinces keep to themselves all the powers not delegated to the federal Government.
